Registration and contract conclusion
The teaching contract is concluded by registering your details and lingo art confirming this in writing and by e-mail to the address provided.
Registration can be made online, by e-mail or in writing. In the case of online registration, clicking on the ‘Register now” button constitutes a binding registration for the offer received. lingo art will confirm your registration by e-mail.
By registering, the validity of these terms and conditions is accepted.
Cancellation of the contract
In addition to the right of withdrawal, as outlined below, the participant may cancel the contract up to 14 days before the commencement of the course without incurring a fee.
In the event of cancellation between 14 days and the day before the course start date, lingo art reserves the right to charge 30% of the course fee. In the event of cancellation on the day before or on the day of the course start date, the full participation fee will be charged. Please note that the cancellation fee does not apply if a replacement participant is registered.
Please note that cancellations must be made in writing and by e-mail, and the relevant date for meeting the deadline is the date of receipt of the cancellation notice by.
Teaching Conditions
A teaching unit generally lasts 45 minutes. On request. 60 minutes are also possible.
For each booking of an in-house course or private lessons, an administrative fee of €75.00 plus VAT will be charged.
For a virtual open course (virtual group course), we charge a reduced administrative fee of €25.00 plus VAT per participant.
You agree to quality control of teaching and trainers to ensure a high standard of quality.
Already paid lessons which have not been taken yet can be transferred to a third person at any time. If lessons are suspended for more than 12 months, then the current prices will automatically apply. If a course has been suspended for at least 24 months and a transfer of the open remaining lessons has not been arranged in the meantime, the booked remaining lessons will expire.
Termination
The teaching contract for an in-house course(courses for corporate clients for a group of employees) or individual lessons can be terminated by either party. Termination is possible at any time with four weeks' notice to the end of the month. Termination notices can be issued in writing or by email. Any excess course fees will be reimbursed.
The teaching contract for virtual open courses or virtual group courses, such as virtual open German (foreign language) with 3 to 6 participants or courses for specialized language education with 5 to 8 participants, runs until the end of the course. Please note that it is not possible to terminate the teaching contract once the course has commenced.
Appointment bookings
For face-to-face lessons, per course date a minimum booking of 2 lessons at 45 minutes = 90 minutes is required, for virtual class a minimum of 45 minutes. For lessons on Saturdays after 12:30 and on Sundays or public holidays, a surcharge of 50% will be added to the course fee.
Schedule changes, and cancellations:
Please notify our organisation of any changes to your course schedule. You can contact us by telephone on 089 13 01 158-0 or by email at info@lingo-art.de. You can also cancel directly with the trainer.
The following applies to individual lessons or in-house courses:
Cancellations of course dates can be made free of charge up to 2 p.m. the day before the scheduled course date. For Monday courses, cancellations can be made free of charge until 2 p.m. on Friday. Lessons cancelled in good time will be made up at the end of the course. Course dates that are not cancelled on time are considered 'late cancellations', for which a charge will be incurred.
The following applies to virtual open or virtual group courses:
These courses are run on a regular basis and can only be cancelled by the trainer. Participants should inform their trainer if they are unable to attend.
Terms of payment
The course fee is generally payable in advance. Invoices are due for payment without any deduction within 14 days after issue of invoice. The course can only start after receipt of payment.
For in-house courses and arrangements involving installment or partial payments, course fees are billed in advance for the agreed-upon period and paid monthly. If more course fees are paid than required for a given period, the unused class sessions may be carried over to the next billing period.
Participants paying on their own account can pay in monthly instalments by SEPA direct debit mandate. The number of instalments depends on the planned course duration. The number and amount of the monthly instalments as well as the payment dates are noted in the offer and on the invoice. If an instalment is not paid or rejected by the participant's bank, we charge € 10.00 plus VAT per chargeback or rejection.
Severability Clause
Should any provision of the General Terms and Conditions be or become wholly or partially invalid, it shall be replaced by a valid provision that most closely reflects the business purpose and the legal meaning of the original provision. No amendment or modification of this Agreement shall be valid unless submitted in writing, agreed upon and signed by both contract parties. The validity of the remaining provisions hereof shall not be affected.
Governing Law and Jurisdiction
German law is the governing law subject to the contractual relationship and other business relations between the customer and lingo art. The exclusive jurisdiction for the parties shall be Munich, provided that this can be agreed. The German AGB in the German language is the original version of our terms and conditions. All questions or issues should be directed to the German version, as this is only a translation.
Deviating agreements
The validity of the remaining provisions remains unaffected.
